Terms and Conditions

These Terms apply to services provided by Cacao Mobile ("Company," "we," "us," or "our"), a company registered at UL Nowogrodzka 31 / 414, 00-511 Warszawa, Poland.

By using the Services, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement.

Cacao Mobile provides a subscription-based mobile application offering health, fitness, and wellness tools and content, including workout programs, nutrition guidance, mindfulness exercises, progress tracking, and related features. The Services are available globally on iOS and Android.

To use the Services, you may need to create an account. You agree to:

• Provide accurate and complete information during registration
• Keep your login credentials confidential
• Be responsible for all activity under your account
• Notify us immediately at support@cacao-mobile.com if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

We may offer a free trial or a paid introductory trial to new users. At the end of either trial, your subscription will automatically convert to a paid recurring subscription at the applicable rate unless you cancel before the trial period expires. Trial offers are available to new subscribers only.

Subscriptions renew automatically on a monthly or annual basis through your Apple App Store or Google Play account. You authorize the applicable platform to charge your payment method at the start of each billing period until you cancel.

We may change subscription prices. We will provide reasonable advance notice before any price increase takes effect. Continued use of the Services after the new price applies constitutes acceptance.

You may cancel your subscription at any time through your App Store or Google Play account settings. Your access continues until the end of the current billing period. Cancellation does not automatically entitle you to a refund.

Refunds are handled in accordance with our Refund Policy, available at Refund Policy. Refund requests are reviewed on a case-by-case basis in line with our Policy and applicable law.

You agree to use the Services lawfully and in accordance with these Terms. You must not:

• Violate any applicable laws or regulations
• Reproduce, sell, or exploit any part of the Services without our written permission
• Reverse-engineer, decompile, or disassemble the application
• Upload or transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to any part of the Services
• Create more than one account per person
• Use automated tools, bots, or scrapers to access the Services

All content, features, and functionality of the Services — including text, graphics, logos, audio, video, and software — are owned by Cacao Mobile or its licensors and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use only.

You may submit content to the Services (e.g., progress data, comments). You retain ownership of your content. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use and display that content solely to provide and improve the Services. You confirm that your content does not infringe any third-party rights.

The Services provide general health and wellness information for educational purposes only. Content within the application is not medical advice and does not replace consultation with a qualified healthcare professional. Always consult your doctor before starting any fitness or nutrition program. We are not liable for any health outcomes resulting from use of the Services.

Your use of the Services is subject to our Privacy Policy. By using the Services, you consent to the collection and use of your information as described therein. For data-related questions, contact support@cacao-mobile.com.

The Services may integrate with or link to third-party platforms (including app stores). We are not responsible for the content or practices of third-party services. Your use of them is at your own risk and subject to their own terms.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CACAO MOBILE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR REVENUES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify and hold harmless Cacao Mobile and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

We may modify or discontinue the Services at any time. We may also update these Terms. We will notify you of material changes by posting the updated Terms in the application or by other appropriate means. Continued use after the effective date of changes constitutes acceptance.

We may suspend or terminate your access to the Services at any time, without notice, if we determine that you have violated these Terms or if termination is necessary to protect the Services, other users, or third parties.

These Terms are governed by the laws of Poland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Warsaw, Poland, without prejudice to your statutory rights as a consumer under applicable local law.
